Clean Indoor Air Regulation

On August 11, 2009, the Muskegon County Board of Commissioners voted unanimously to adopt the Muskegon County Clean Indoor Air Regulation. This regulation prohibits smoking within closed areas at public and private workplaces, other than bars, restaurants and tobacco specialty stores. Private residences that are used as a child care, health care or adult day care facility or as a business open to the public must also comply with this regulation. The regulation took effect November 9, 2009.

    

On December 10, 2009, the Michigan legislature passed the Dr. Ron Davis Smoke-Free Air Law. The Governor signed the bill into law on December 18, 2009. This law takes effect May 1, 2010 and prohibits smoking in most public places in Michigan. This law covers public places, including, but not limited to, restaurants, bars, shopping malls, bowling alleys, concert halls, arenas, museums, mechanic shops, health facilities, nursing homes, education facilities, and child care centers.

    

On March 9, 2010, the Muskegon County Board of Commissioners voted to amend the Muskegon County Clean Indoor Air Regulation to comply with Section 2441 of the Michigan Public Health Code. Section 2441 requires that local public health regulations be at least as stringent as the standard established by state law applicable to the same or similar subject matter.

    

Both the amended Muskegon County Clean Indoor Air Regulation and the Dr. Ron Davis Smoke-Free Air Law take effect on May 1, 2010.
